The Back Catalog aggregates publicly available product and price data from third-party luxury resale platforms (“Source Platforms”) and presents that data in a searchable, comparable format. We do not buy, sell, authenticate, warehouse, or ship any items. All transactions are completed exclusively on the Source Platforms. Prices displayed on the Service are indicative only and may differ from prices available at the time you visit a Source Platform.

The Service contains links and data sourced from third-party resale platforms. We have no control over the content, availability, or practices of these platforms. Your use of any Source Platform is governed by that platform's own terms and privacy policy. We are not responsible for the accuracy of listings, the authenticity of items, or any dispute arising from a transaction on a Source Platform.
All content on the Service — including design, text, graphics, software, and the compilation and arrangement of aggregated data — is owned by or licensed to The Back Catalog and protected by applicable intellectual property laws. Product images and listing data remain the property of the respective Source Platforms and are used for informational comparison purposes only. Nothing in these Terms grants you any licence to use our trademarks, logos, or proprietary data without our prior written consent.
If you submit content to the Service (such as catalog entries or feedback), you grant us a worldwide, royalty-free, non-exclusive licence to use, display, and adapt that content solely for the purpose of operating the Service. You represent that you own or have the necessary rights to submit such content and that it does not violate any third-party rights.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Price data is sourced from third-party platforms and may be inaccurate, incomplete, or outdated. We do not guarantee the authenticity, condition, or availability of any listed item.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE BACK CATALOG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS.

You agree to indemnify, defend, and hold harmless The Back Catalog and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate business reason. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, 11, and 14 survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. If you are a consumer in the EEA, you may also bring claims before the courts of your country of residence, and mandatory consumer protection laws of your country may apply.
These Terms, together with the Privacy Policy and any additional terms applicable to specific features of the Service, constitute the entire agreement between you and The Back Catalog regarding the Service and supersede all prior agreements or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
